Terms and Conditions {Plain English Version}
Please read these terms and conditions carefully before ordering any products from our website.
You should understand that by ordering any of our products, you agree to be bound by these simple terms and conditions.
Simply Add Water Ltd and its' associated companies reserves the right, at any time, to modify, alter, or update these terms of use, and you agree to be bound by such modifications, alterations, or updates on subsequent visits.

1.CONDITIONS
1.1 In these terms and conditions:
'goods' means the goods (including any instalment of the goods or any parts for them) which the Supplier is to supply in accordance with these terms and conditions
'Supplier' means Simply Add Water Ltd and its' associated companies.

2. ORDERING OF GOODS
2.1 On completion of placing your order online, you will receive an email acknowledgement (to the email address provided when placing the order). Please note that this does not mean that your order has been accepted by us. The contract between us is formed when the goods are despatched. We (Simply Add Water Ltd and its' associated companies) reserve the right, at any time prior to acceptance, to refuse any order or any part of an order.
2.2 If goods are ordered over a weekend, Bank Holiday or after 2.00pm the order date is taken as the next working day.
2.3 If any goods are priced in error, Simply Add Water Ltd and its' associated companies will not be bound to honour incorrect prices.
2.4 Goods may be shown as 'in stock' on the web site. Due to the way we sell our products there will be times when the stock figure is incorrect and the goods are not in stock. We will email you to advise you if this is the case giving you the option to wait or to cancel the product and receive a refund.

3. CANCELLATION OF ORDER (Prior to Delivery)
3.1 To cancel your order please email us as soon as possible .
3.2 If the order has already been despatched from the warehouse, you will be unable to cancel your order. In these circumstances you will have to return the goods yourself, or refuse the delivery after you have notified us that you are doing so, as stated under the Returns Policy.
3.3 Bespoke items, such as Whirlpool baths, fitted bathroom furniture etc may not be cancelled after ordering.
3.4 Refunds will be issued as soon as possible and in any case, within 14 days. If you do not receive it please email us.

4. DELIVERY OF GOODS
4.1 The delivery of goods to you is deemed to be a separate contract for services be it free or paid for, distinct from your contract to purchase the goods.
4.2 For goods which are shipped on a pallet or van, the goods will be delivered as close as possible to your front door. The delivery drivers are not insured to take their vehicles off the public highway across fields etc. If your property is unreachable for any reason delivery will be made as near to your property as possible. Email and tell us of any delivery issues.. This makes life easier all round.
4.3 The refusal of a delivery due to examples in 3.2 and 4.2, will lead to the actual delivery costs and collection fees being charged.
4.4 The delivery may be made by a single driver, so please ensure at least one able bodied person is available to assist the driver with the carrying.
4.5 The driver is NOT insured to take the goods inside your property. So therefore if the goods ordered are of a heavy or bulky nature, it is strongly recommended that at least two able bodied persons are available to get the goods inside the property. Plan Ahead..
4.6 Delivery dates (inc. Next Day deliveries) are approximate and no liability whatsoever is accepted by us in respect of late deliveries. Please do not arrange fitting of the items until they have been delivered and checked for discrepancies or damages. Delivery vehicles sometimes get stuck in traffic, breakdown, get delayed, crash, get stolen. Drivers get sick, overlay, etc. Please understand that sometimes events are out of our control. Although rare, these things, and others can sometimes affect delivery schedules.

5. DAMAGES & SHORTAGES

5.1 Small items that arrive by courier { Parcelforce etc}, you agree to open all boxes, thoroughly check the goods for damage and notify us via email if there is any damage or shortage. We allow a period of 2 working days to check them. All we ask you to do is check the goods within 2 days as we can only make a claim ourselves within 2 days of the goods being delivered to you. So please do check the delivery so we can claim and we can get the item changed for you quickly. If the packaging of the item appears damaged on delivery, please write 'damaged' on the delivery note if possible and check the items within 2 days. The courier drivers will not wait whilst you check the product. This is reasonable, as they have other customers just like you, waiting for their delivery too.

5.2 For items which are despatched using a pallet or carrier service you agree to check the goods as soon as possible within our terms for damage.
5.3 If part of a multiple item order is damaged on delivery, accept all of the order but make a note on the delivery note which item(s) are damaged. Notify us within 2 days and we will arrange collection of the damaged item(s) and delivery of the replacement item(s). Do not refuse delivery unless all items are damaged. See 5.2 above.

5.4 If you appoint someone else to receive and sign for the goods on your behalf, Make sure that they check for any obvious signs of damage.
5.5 Simply Add Water Ltd and its' associated companies cannot consider any claims for damage or shortages 2 days after delivery. As we explained we need to claim on our carriers in that time as well.. So PLEASE CHECK YOUR GOODS
5.6 From the time of receipted delivery of the goods. Any loss or damage to the goods shall be at your own risk.
5.7 If a bespoke item arrives damaged, a replacement will be despatched once manufactured.
5.8 In all cases we may request a photograph of the item and the damage for our insurance purpose. These must be emailed to us within 2 days.

6. RETURNS POLICY - Non-Faulty Goods
6.1 If you do not require a product when you receive it, you may cancel your order at any time until the end of the 14th working day after the day on which you receive your goods. Notification Via email or Cancellation form is required. The goods must be un opened and in their original un damaged packaging.. This is so we can sell them on again. We can and will deduct a fee if we have to buy a new box or send it off to be re packaged. Please note that manufacturers and distributors will very often have their own set of charges for returns which will be forwarded to you the purchaser. So please measure twice and order once.
6.2 If you cancel your order under these provisions, then you will be responsible for returning the goods to us in good resalable condition please do not open the goods if you have cancelled the order. You will have to pay for the return of the goods to us. We will refund you only at our standard rate of postage.
6.3 Due to hygiene concerns toilet seats and shower seats cannot be returned, once opened.
6.4 Bespoke items cannot be returned. { eg: whirlpool baths - specially made seats and furniture - anything altered from its original state such a colour change - drillings - cutting to size etc}
6.5 Spares for showers and taps cannot be returned to us.

7. RETURNS POLICY - Faulty Goods

This applies to goods which develop a fault after installation and not transit damage (please see section 5, for damaged goods in transit).
7.1 All goods supplied by Simply Add Water Ltd and its' associated companies come with a 12 month or longer manufacturer's guarantee. When products are stated as having longer guarantees, these guarantees are covered by the manufacturer and not Simply Add Water Ltd and its' associated companies.
7.2 In the event of faulty goods being returned at the expense of the customer, Simply Add Water Ltd and its' associated companies will refund reasonable postage costs. Based on our standard delivery.
7.3 All returned faulty goods are tested by the manufacturer, and if the item is not faulty the product value will be refunded minus the cost of the testing process.
7.4 In most cases the manufacturers offer a service/breakdown engineer service who will visit your property to repair or replace the faulty item. If the fault is not causing any damage, please do not remove the installed item as this could void your guarantee. We find that it is quicker if you contact the manufacturer directly, to arrange a call from an engineer in the case of a product developing a fault. But feel free to call us and we will do it for you.

8. COLLECTION OF GOODS
8.1 Goods cannot be collected from us.

9. DELIVERY OF GOODS, SERVICE OF CONTRACT
9.1 If you select the delivery option during the checkout stage, you are agreeing to enter into the delivery service contract.
9.2 Once the items have been despatched from our warehouse the service contract cannot be cancelled.
9.3 The refusal of a delivery (unless you have cancelled the order in writing etc), will lead to the actual delivery costs and collection fees being charged. Please note that the actual costs will be considerably higher than the standard price you were originally charged.
9.4 Do not refuse delivery of a pallet unless all items are damaged (see 5.3), as you will be charged the actual delivery cost and collection fee.

9. WARRANTY
9.1 This warranty does not apply to any defect in the goods arising from fair wear and tear, wilful damage, accident, negligence by you or any third party, use otherwise than as recommended by the supplier, failure to follow the suppliers instructions, misuse, or any alteration or repair carried out without the suppliers approval.

10. WRITTEN COMMUNICATIONS
10.1 By law we have to provide written information to you regarding your rights as a consumer. When using our site, you are accepting that we can send this information electronically to you (on the email you supplied when placing your order) and accept that these contracts and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing.

11. EXTERNAL SITES
11.1 Simply Add Water Ltd and its' associated companies is not responsible for the availability of, or content located on or through any external site linked to us, nor for any transactions between you and such sites.
